Officers Won’t Face Federal Charges in Sean Bell Killing

Citing insufficient evidence, federal authorities said Tuesday that they would not bring a civil rights case against the New York City police officers involved in the killing of Sean Bell, a 23-year-old black man who was shot by the police outside a strip club in Queens on his wedding day.



The decision by the Justice Department came after prosecutors and federal agents reviewed the case, in which five police officers fired 50 shots into the Nissan Altima that Mr. Bell was driving. The car struck a detective in the leg and hit a police van just before the officers began firing their weapons.

Mr. Bell was killed and two passengers, Trent Benefield and Joseph Guzman, were wounded. None of the men had guns, although the police officers apparently believed at least one did.

In their review, officials from the Civil Rights Division of the Justice Department, the United States attorney’s office for the Eastern District of New York and the Federal Bureau of Investigation did not find enough evidence to prove that the officers had willfully acted to deny the men their constitutional rights, according to a statement from the Justice Department.

“Neither accident, mistake, fear, negligence, nor bad judgment is sufficient to establish a federal criminal civil rights violation,” the statement said.
Any disciplinary action now lies with the Police Department, whose critics saw the shooting as an indictment of police training and the department’s use of deadly force.

The department can now pursue an administrative review of the case and the officers involved. Seven officers, including four of the five who shot at the car, have been internally charged with breaking departmental rules.

Of the five who opened fire — Detectives Gescard F. Isnora, Michael Oliver, Marc Cooper and Paul Headley and Officer Michael Carey — all but Detective Headley remain on desk duty, with no gun and shield, said Paul J. Browne, the department’s chief spokesman. Lt. Gary Napoli, the supervising officer that night, is also on desk duty, he said, facing internal charges of failing to supervise the operation.

Two other officers, Detective Robert Knapp and Sgt. Hugh McNeil of the Crime Scene Unit, were also charged internally, the detective with failing to thoroughly process the crime scene and the sergeant with failing to ensure that thorough processing was done.

If internal charges are substantiated, some of the officers could be fired. Mr. Browne said that the police commissioner, Raymond W. Kelly, would not comment on the matter because “he is the final arbiter” of any punishment.

Detectives Isnora, Oliver and Cooper were acquitted by a Queens judge in April 2008 of criminal charges. The two other officers who opened fire were not charged criminally.

On Tuesday, federal officials met with Mr. Bell’s family; his fiancĂ©e, Nicole Paultre Bell; and others to tell them of their decision. Later, many in the Bell family and their supporters expressed disappointment in a news conference at the headquarters of the Rev. Al Sharpton’s National Action Network.

Ms. Paultre Bell said she hoped to get the attention of the White House. “There is a history of black men being killed by police officers, and something needs to be done,” she said. “We’re hoping to eventually meet with President Obama, and that he’ll do something, because this is a national problem.”

Michael Hardy, a lawyer for Ms. Paultre Bell and for Mr. Benefield and Mr. Guzman, read a statement from Mr. Sharpton, who has been a spokesman for the Bell family.
Using a cane and wearing a boot on his right foot, Mr. Guzman called Mr. Bell “the people’s champ” and asserted that police violence was disproportionately affecting urban communities and black and Latino men.

Lawyers for the officers involved expressed support for the government’s position.
Paul P. Martin, a lawyer for Detective Cooper, said he was not surprised by it. “There’s no basis for them to bring a federal proceeding,” Mr. Martin said.
Anthony L. Ricco, the lawyer for Detective Isnora, who was struck by Mr. Bell’s car and who fired the first shot, said he spoke with his client, who was “very relieved.”

The lawyer added that Detective Isnora was hopeful he would be cleared of internal charges and that he hoped to attend law school.

Detective Oliver, who fired 31 shots, was told of the decision by his lawyer, James J. Culleton. “I called him, and he was very relieved and very happy,” Mr. Culleton said. “It took a long time for this decision to come down.”

Michael J. Palladino, the president of the Detectives Endowment Association, said he was “gratified” with the government’s decision.

Mr. Benefield, Mr. Guzman and the family of Mr. Bell still intend to move ahead with a civil lawsuit. Mr. Sharpton said he hoped that a civil case, as well as possible departmental charges, would “bring some justice” to Mr. Bell’s family and his wounded friends.

TRENTON — Even if it didn’t go off entirely as planned, Friday night’s “Return of the God MCs” concert at the Patriots Theater at the Trenton War Memorial can be considered a rousing success.

The headliner, of course, was Rakim, but the real star of the night was Wise Intelligent, the front man for Poor Righteous Teachers, a poster child for both life in — and a path out of — the city.

After his roughly half-hour set, Wise Intelligent joined the media in the back of the ballroom and spoke candidly and passionately about when he believes hip-hop’s paradigm shifted from a message of righteousness and positivity to one of materialism, violence, selfishness and greed.

“It shifted after 1992, after the riots behind Rodney King,” he said. “That’s when I started to see the change. Poor Righteous Teachers were in their second recording ... it was called ‘Pure Poverty.’ We were explaining poverty and what it can do to a youth.

“So 1992 is when it shifted, because after the Rodney King riots, the youth were motivated to attack the cause of their problems, which was the system. Rodney King gets beaten in front of everybody, and they say ‘Yo, no, they’re not guilty. Let them go,’ and the police get off.”

From there, Wise Intelligent says, the mindset of the nation’s young and impoverished went from betterment of their selves, to attacking what they believed was the cause of their struggles.

“The youth, from listening to ‘Fight the Power,’ from listening to Public Enemy, to KRS-One, they were motivated to the right move. They were politically oriented in the right direction.

“So they said, ‘Hey, we can’t have this. How do we stop these kids from listening to the cause of their immiseration?’ So they shift the paradigm.”

Of course, words alone can only do so much. That’s why Wise Intelligent has established Intelligent Seedz, (http://www.intelligentseedz.org ) a Trenton-based nonprofit based that, through short, independently filmed documentaries, aims to “give at-risk youth the necessary skill set to tell their unique stories through film.”

One film, “Dying to Learn,” (http://vimeo.com/4907698) and PSA (http://www.youtube.com/watch?v=TyY2RyMLCuo) about the effects of lead poisoning, has been honored by the Environmental Protection Agency.

Brand Nubian performed after Wise Intelligent, throwing together a hit-packed set that featured “Punks Jump Up to Get Beat Down,” “One for All” and “Slow Down” in succession.

Then, after a brief intermission featuring a DJ spinning classics, Rakim emerged to fevered applause.

The God MC himself opened with “Holy Are You,” the first single from his latest release, “The Seventh Seal.”

He followed with a string of classics, including “Eric B. is President,” “Paid in Full,” “Guess Who’s Back” and “I Ain’t No Joke” among others.

Because of timing issues stemming from the late arrival of artists, however, most of Rakim’s songs had to be shortened to a verse.

After the post-concert meet- and-greet, Rakim, surrounded by about 10 people in his dressing room, met with The Trentonian and explained the importance of the show.

“It’s a good feeling being back in Jersey, especially down in Trenton. I haven’t been over here in a while, and it just feels good to get out there and give some love and get some back.

In the final question of the evening, Rakim acknowledging that it had, indeed, been a long time, between albums, explained the delay and promised there would be no such delay this time around.

“I want to get on it right away so it won’t take so long this time. It’s different now, I’ve got my business together — that was one of the things that took so long, just getting the business right so I could put this out on my own label, and we did that.

“So hopefully now there won’t be too many setbacks and I can drop something by the end of the year.”

Judging by the response he received last night, if Rakim makes good on his word, the fans will definitely welcome it with open ears.

Upon hearing the hideously disturbing news concerning child stealing in poverty stricken, earthquake devastated Haiti - after a spiritually heavy gasp - I was able to gather my thoughts (as I have become accustomed to doing) and not “react” according to anger, frustration or activist fatigue. I had to push refresh on my neurological data-base of stored information, things studied and lessons learned. In less than 60 seconds every repulsive incident of child trafficking I had ever forced myself to read flashed before me almost as if I had Googled them.

My consciousness was speedily directed to 2003 when a UN ship of “peacekeepers” was implicated in facilitating a child prostitution ring. The Associated Press report said that the ship chartered to peacekeepers in East Timor is also “being used to bring child prostitutes to the island nation.” Expresso, the Portuguese weekly reported that “UN personnel were involved in bringing girls from Thailand to East Timor as prostitutes.”

Then there was the UK’s Guardian report November 27, 2002 titled “Portugal's elite linked to pedophile ring,” the report talks about how the investigation threatened to “engulf diplomats, media personalities and senior politicians.” These are very disturbing examples of “spiritual wickedness in high places” authorities abusing the peoples trust in the most unforgivable ways. The former Secretary of State for Family’s lamented that she had given the police ample evidence 20 years ago found at the home of an important diplomat where four “missing” orphans were found under lock and key – evidence which included "photographs, an account of the methods used to spirit children out of the orphanage and testimonies of a number of children," all of which police ignored.

Again, many of us were effectively distracted by the nomination of America’s first black president, Wall Street’s contrived march toward the precipice of collapse and its anticipated bailout on the backs of America’s working poor – that we all but missed the 2009 Press TV report that revealed how Blackwater - the controversial U.S. government backed private corporation of mercenaries “used child prostitutes in Iraq.” The article added that “Iraqi minors got involved in sexual acts with Blackwater members in exchange for one dollar.” It goes on to declare that Erik Prince, the firm's owner, "failed to stop the ongoing use of prostitutes, including child prostitutes, by his men."

We “Americanized” citizens of the West often sigh in the ignorance induced, but comforting relief that this is happening in Thailand, Portugal, Iraq, the Sudan, Congo and not in America. However, when we turn the hands of our almost extinct analog wall-clocks back to the 1980’s we immediately come face to face with the Nebraska child pedophile ring that was discovered to have went all the way to the White House.

The front page of the Thursday, June 29, 1989 Washington Times read “Homosexual Prostitution Inquiry ensnares VIPs with Reagan, Bush: Call Boys took Midnight Tour of White House.” The article said that the Washington D.C. operator of the ring was the well known Republican Party lobbyist and homosexual Craig Spence. The Times confirmed that “Mr. Spence arranged at least four midnight tours of the White House including one June 29, 1988, on which he took with him a 15 year old boy whom he falsely identified as his son.”

Many children were flown in on planes from Nebraska orphanages by top political officials, for child sexual services provided for key bureaucrats, diplomats and politicians. The operator of the Nebraska arm of the ring was none other than nationally active Republican politician Larry E. King, who was finally convicted on embezzlement charges in a trial wherein State Sen. Ernie Chambers of Omaha said that he had “received numerous reports to which he clearly gave credence, that child sexual and physical abuse were linked to the scandal.” Larry E. King Jr. – a black man – sang the National Anthem at the 1984 Republican National Convention.

This article is a sketch of what comes to mind when I read about people stealing Haitian children, a “thinking out loud” of sorts. These are your elected officials funding orphanages with mission statements lauding the noble aim of caring for children without families, but sexually and physically abusing them. These are pedophile politicians brought to you courtesy of the citizens of the United States of America, and the world!
